2. The petitioner apprehends his arrest in connection with Wazirganj P.S. Case No. 845 of 2024, registered for the offences punishable under Sections 115(2), 109, 303(2), 3(5) of BNS.

3. As per allegation, the petitioner along with other coaccused persons is said to have poured petrol on daughter of the informant and set her ablaze as a result of which, she sustained burn injuries and later on, she succumbed to the injuries during treatment.

4. The learned senior counsel for the petitioner has submitted that the petitioner has clean antecedent and has

He also submits that the victim admittedly was in love with the petitioner for three years for which the family members of the petitioners were not happy and according to the FIR, brother of the petitioner had assaulted and snatched the mobile phone of the victim (deceased), prohibiting her from talking with his brother. He further submits that the family members of the petitioner have been arrayed as accused in the present case, who may have grudge against the victim as they were not happy for having her relation with the petitioner and hence, the petitioner who has love and affection with the victim (the deceased), cannot have complicity in the alleged occurrence.

5. On the other hand, the learned counsel for the informant has opposed the prayer for bail by submitting that the victim has suffered 72 per cent burn injuries and she died in PMCH, Patna. It is further submitted that though, it is true that the petitioner and the victim were in love but the petitioner was also present at the spot.

6. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs.

No.25941 of 2025(4) dt.07-10-2025 3/3 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Gaya in connection with Wazirganj P.S. Case No. 845 of 2024, subject to the conditions as laid down under Section 438(2) Cr.P.C./ 482(2) of the BNSS, 2023.
