The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 323, 342, 386, 307, 420 and 406/34 of the Indian Penal Code. The prosecution case is that petitioner no.1 along with the complainant decided to purchase a particular piece of land in which complainant has 20% share. Consequently, an agreement was prepared and the complainant paid Rs. 1,84,000/- but neither the possession was given nor the invested amount of the complainant was returned.

It is submitted by learned counsel for the petitioners that in the background of land dispute the accusation has been levelled and there is nothing on record with regard to payment

Patna High Court Cr.Misc. No.53105 of 2015 (2) dt.23-11-2015 2/2 made to the petitioners. Moreover, a statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Nawada in connection with Mufassil P.S. Case No.14 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
