Learned counsel for the State and learned counsel for the Bihar Public Service Commission are present.

The present application has been filed by the petitioners for directing the respondents to appoint the petitioners on class-III, post in regional offices (District Level) in the district of Buxar pursuant to the recommendation of Bihar Public Service Commission.

It has been contended by learned counsel for the State that the present application has become infructuous as all the three writ petitioners have already been appointed on 13th June, 2008 at different places. He has further submitted that petitioner no.1 Sujeet Kumar was appointed on 8th July, 2008 and was posted in Circle Office, Rajpur, petitioner no.2 Rajesh Kumar Roy was posted in Legal Section, Collectorate, Buxar and petitioner no.3 Rahul Kumar Singh has been posted in Block Office,
