Mr. Ravi Kumar, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 30-04-2026 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the Bihar Staff Selection Commission (B.S.S.C.).

2. The present writ petition has been filed for issuance of an appropriate writ(s)/order(s)/direction(s) to the respondents for the following relief/s:-

Patna High Court CWJC No.7961 of 2025(2) dt.30-04-2026 2/3 "I. To direct the Respondents especially respondent District Magistrate, Patna to send the list of existing 362 vacancies of Class IV Post of all the department in the district including the Collectoriate, Patna to the General Administration Department, govt. of Bihar, Patna. So that the Bihar Staff Selection Commons will gives the result of 312 applicant who has given written test on 15.09.2024.

II. For that further direction may be given to respondent authorities so concerned to dispose of representation dated 20.01.2025 given by the Petitioner.

III. For that any other relief or reliefs may be given to the petitioner which your lordships may deem fit and proper."

Learned counsel for the petitioner submits that he has filed representation dated 20.01.2025 before the District Magistrate, Patna (Annexure-4) in which request for sending the 362 vacant post has been made. Counsel submits that on his representation, no order has been passed by the District Magistrate, Patna.

4. Learned counsel for the State submits that counter affidavit has been filed and in the counter affidavit, a decision has been taken vide Memo No. 1237 dated 24.04.2025,

Patna High Court CWJC No.7961 of 2025(2) dt.30-04-2026 3/3 according to which, all vacancies were fulfilled except two and last two persons have already been appointed and at present, there is no vacancy at all. Counsel submits that further vide Letter No. 667 dated 03.03.2025 (Annexure-C), the Additional Collector Establishment, Patna has issued a letter in which clarification with regard to 362 vacant post has been made.

5. In this background that after representation filed by the petitioner on 20.01.2025, a letter has been issued by the Additional Collector Establishment, Patna contained in Letter No. 667 dated 03.03.2025, in which, clarification with regard to said vacancies has been made.

6. This Court is of the view that there is no need to issue any direction to any of the authorities. However, the petitioner is free to take decision, in consultation with his counsel, after going through Annexure-C, in accordance with law. Accordingly, this writ petition stands disposed off.
