This is the third attempt on behalf of the petitioner for grant of bail in a case registered under Sections 363, 366A, 376, 216, 120B IPC and Section 4/6 of the Prevention of Children from Sexual Offences Act.

The petitioner has now been in custody for about two years i.e. since 17.9.2017. Deposition of the victim girl recorded in the trial before the Additional Sessions Judge -cum Special Judge, Darbhanga on 28.2.2019 have been brought on record. Placing reliance on the same, petitioner's Counsel submits that the victim girl has accepted the fact of her making conflicting statements in her deposition before the Magistrate and police as she was in duress.

Patna High Court CR. MISC. No.23895 of 2019(3) dt.07-08-2019 2/2 Learned APP for the State submits that nature of allegations against the petitioner are heinous and this Court should not allow prayer for bail of the petitioner. Having regard to the aforesaid submissions this Court would direct that the petitioner be released on bail. Let the petitioner namely Ranjan Thakur be enlarged on bail on his furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of lst Additional Sessions Judge -cum- Special Judge (POSCO ACT) Darbhanga.
