JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-10-2020 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner apprehends her arrest in Sarai P.S. Case No. 16 of 2020 registered for the offence under Sections 467, 468, 471, 420, 120(B) of the Indian Penal Code. As per the prosecution case, co-accused Shyam Kishore Sharma illegally executed a sale-deed in favour of his wife Kiran Devi (petitioner) with respect to 19 decimals land of informant. It is further alleged that similar nature of case is also pending against this petitioner and other co-accused. It is submitted on behalf of petitioner that petitioner and informant are own gotini and petitioner is a bonafide purchaser of the land in question and only with a view to grab the land of petitioner, the present case has been lodged. It is further submitted that the share of the co-accused Shyam Kishore Sharma has been transferred in favour of his wife i.e.
Patna High Court CR. MISC. No.27215 of 2020(2) dt.21-10-2020 2/2 this petitioner. It is further submitted that the allegations, made in the FIR, are purely civil in nature.
Considering the aforesaid facts and circumstances, the bail application of petitioner is allowed. In the event of her arrest or surrender within a period of eight weeks from the date of receipt/production of copy of this order, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - XIII, Vaishali at Hajipur in connection with Sarai P.S. Case No. 16 of 2020, subject to condition as laid down under Section 438(2) of the Cr.P.C.
