The petitioner, who is in custody since 01.03.2020, seeks bail in connection with Hajipur Sadar P.S. Case No. 150 of 2020, dated 29.02.2020, instituted for the offences under Sections 364(A) and 120(B) of the Indian Penal Code. It has been submitted on behalf of the petitioner

No.26986 of 2020(3) dt.01-12-2020 2/3 that the First Information Report has been lodged by the wife of the victim, who has alleged that her husband was kidnapped on gunpoint and shortly thereafter, she was informed on her mobile telephone that her husband shall be released only on paying an amount of Rs. 1,00,000/- as ransom. While concluding her First Information Report, the informant has stated that all the persons had concealed their identity, but she could identify the petitioner and another person vaguely.

Learned counsel for the petitioner has submitted that his implication is only on the account of such statement in the F.I.R. The victim, after his recovery, gave his statement under Section 164 Cr.P.C., in which, he has not even named the petitioner nor has he, even in the least, alluded to the participation of the petitioner in the offence. The other accused persons of this case have already been granted bail, as stated by the learned counsel for the petitioner.

Considering the period of custody of the petitioner and the nature of accusation levelled against him, he is
