2. The petitioner seeks bail in connection with Sarsi P.S. Case No. 30 of 2023, dated 15.02.2023, instituted for the offences punishable under Sections 08(c)/21(B)/22(B) of the N.D.P.S. Act.
3. As per the case of prosecution, 7.30 grams of smack (Brown Sugar), mobile, SIM and electronic weighing machine have been recovered from the house of the petitioner.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. It is submitted that nothing has been received from the conscious possession of the petitioner. It is further submitted that the seized quantity is little more than the small quantity and
Patna High Court CR. MISC. No.26440 of 2023(2) dt.24-05-2023 2/2 much less than the commercial quantity. Lastly, it has been submitted that the petitioner is in custody since 16.02.2023, has no criminal antecedent and charge-sheet has been submitted in the case.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, N.D.P.S. Act, Purnia in Sarsi P.S. Case No. 30 of 2023. (Khatim Reza, J) shanu/- U T
