The petitioners are apprehending arrest in a case registered for the offences punishable under sections 427,341,323,353,354 and 379/34 of the Indian Penal Code. The prosecution case is that the informant being the Headmistress of the school, objected for making attendance by Abdul Sattar Khalifa, teacher of the school when he tore the attendance register and the inspection register. The petitioners being the accomplices of Abdul Sattar Khalifa, caught hold of the informant and snatched the gold chain and exhorted to assault.

No.53508 of 2015 (2) dt.24-11-2015 2/2 It is submitted by the learned counsel for the petitioners that since the informant did not intend to hand over the charge to Abdul Sattar Khalifa who was posted as Headmaster of the school, she filed the present case with malicious accusation. It is further submitted that the petitioners have been roped in the present case since mother of petitioner no. 4 being the President of the school committee opposed the above activities of the informant . Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioners by the learned court below in case the petitioners surrender within six weeks from today in connection with Kudra P.S. Case No. 239 of 2015 pending in the court of learned CJM, Kaimur (Bhabua). This application is disposed of with the aforesaid observation/direction.
