1. Heard the parties.
2. The petitioners apprehend their arrest in connection with Amarpur P.S. Case No. 529 of 2024 dated 06.08.2024 registered under Sections 80(2), 3 / 5 of the B.N.S.
3. As per the prosecution case marriage of the informant's daughter was solemnized with the co-accused on 22.06.2022 and one child was born out of the wedlock between them. It has further been alleged that the petitioners along with other accused persons started demanding dowry of Rs. 2 lakh and one bullet motorcycle and due to non fulfillment of the demand they tortured the informant's daughter. On 05.08.2024 the informant received information from one unknown person that
Patna High Court CR. MISC. No.26063 of 2025(2) dt.06-05-2025 2/3 her daughter Khushboo Kumari (deceased) has been killed by the accused persons by pressing her neck. When the informant reached her daughter matrimonial home she found her daughter dead and saw ligature mark on the neck of her daughter.
4. Learned counsel for the petitioners submits that petitioners have not committed any offence in the manner alleged. The petitioner no. 1 is the sister-in-law (gotni) and petitioner no. 2 is the father-in-law of the deceased. The demand of dowry from the deceased and her family members is false and concocted. The fact of the matter is that deceased died due to snake bite which would be evident from the post mortem report in which doctor after considering the report of Regional Forensic Science Laboratory, Bhagalpur has given his opinion regarding the cause of death saying that the cause of death is snake bite and its complication.
5. Regard being had to the submission made by the parties, taking into consideration the post mortem report (Annexure-2) and the opinion of the doctor, I am inclined to grant anticipatory bail to the petitioners.
6. Let the petitioners, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on

No.26063 of 2025(2) dt.06-05-2025 3/3 furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Banka in connection with Amarpur P.S. Case No. 529 of 2024 subject to the condition as laid down under Section 482 (2) of the B.N.S.S. 2023.
