====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 14-08-2025 Heard Mr. Anil Kumar, learned counsel appearing on behalf of the petitioners and Mr. Surendra Kumar, learned APP for the State.
2. At the outset, learned counsel appearing on behalf of the petitioners seeks to withdraw the prayer for pre-arrest bail on behalf of the petitioner no.2 informing that petitioner no.2 has been arrested during the pendency of the bail application.
3. The prayer for bail on behalf of petitioner no.2 is
Patna High Court CR. MISC. No.25857 of 2025(3) dt.14-08-2025 2/3 dismissed as withdrawn.
4. The petitioner no.1 and 3 to 6 seek pre-arrest bail in connection with Turkauliya P.S. Case No. 504 of 2024 registered for the offence punishable under Sections 190, 126(2), 115(2), 110, 76, 303(2), 352 and 351 (2) of the B.N.S.
5. As per the allegation made in the F.I.R., all the accused persons with an intention to kill assaulted the informant and his wife and also outraged her modesty and snatched Mangalsutra.
6. Learned counsel appearing on behalf of the petitioners submitted that the petitioners are innocent and there is no specific allegation against any of the petitioners. On the said basis, learned counsel seeks that the petitioners be released on pre-arrest bail.
7. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioners.
8. Considering the rival submissions made on behalf of the parties, as well as, the allegation made in the F.I.R. and in want of any specific allegation against the petitioners, the petitioner no.1 and 3 to 6, are directed to be released on prearrest bail, in the event of their arrest or surrender before the Court below within a period of four weeks from today, on
Patna High Court CR. MISC. No.25857 of 2025(3) dt.14-08-2025 3/3 furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, East Champaran at Motihari in connection with Turkauliya P.S. Case No. 504 of 2024, subject to the condition as laid down under Section 438(2) Cr.P.C / 482(2) BNSS.
9. The District Court is directed to verify the criminal antecedent of the petitioners and if it is found that the petitioners are involved in some other cases as what has been stated in Para-3 of the bail petition, this order will automatically lose its force.
10. The bail application stands disposed of.
