The petitioner apprehends his arrest in Kuchaikote P.S. Case No. 18/2015, registered for the offences punishable under Sections 406, 420, 384 and other Sections of the Indian Penal Code.
The informant Sri Kant Singh lodged a Complaint Case No. 1981/2014, on the basis of which the present FIR was lodged making allegation that the petitioner was running a Cheat Fund Company. The informant and others deposited money in the company but after maturation the petitioner and others did not pay the amount to the subscribers of the cheat fund company. Learned counsel for the petitioner submits that firstly Kuchaikote P.S. Case No. 125/2013 was registered by one Ravindra Dubey and the petitioner had been granted anticipatory
Patna High Court Cr.Misc. No.43266 of 2016 (3) dt.22-11-2016 2/2 bail vide order passed in Cr. Misc. No. 2890/2014 on 20.01.2014. The informant and other witnesses of Kuchaikote P.S. Case No. 125/2013 lodged three cases i.e., Kuchaikote P.S. Case No. 17/2015, Kuchaikote P.S. Case No. 18/2015, the present case and Kuchaikote P.S. Case No. 19/2015. The petitioner has already been granted anticipatory bail vide order dated 19.10.2016 passed in Cr. Misc. No. 43770/2016 in connection with Kuchaikote P.S. Case No. 19/2015. The petitioner has been granted anticipatory bail vide order passed in Cr. Misc. No. 42458/2016 in Kuchaikote P.S. Case No. 17/2015.
Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VIII, Gopalganj in connection with Kuchaikote P.S. Case No. 18/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
