The petitioner seeks bail in connection with Masrakh P.S. Case No. 535 of 2019, dated 10.12.2019, instituted for the offences under Sections 272, 273, 467, 468, 471 and 414 of the Indian Penal Code and Sections 30, 30(a), 36, 38

Patna High Court CR. MISC. No.26970 of 2020(2) dt.19-10-2020 2/3 and 41 of the Bihar Prohibition Act, 2016.

The prayer for bail of the petitioner was earlier rejected vide order dated 06.02.2020 passed in Cr. Misc. No. 6885 of 2020 with an observation that he may renew his prayer for bail after framing of the charge.

Mr. Mishra, learned counsel for the petitioner has submitted that because of the COVID pandemic, charges have till not been framed and the petitioner is in custody since 11.12.2019. He has further submitted that out of several persons who are engaged in the unloading of liquor from a vehicle, the petitioner also was one of them.

Regard being had to the period of custody of the petitioner and the nature of accusation against him, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions Judge-Cum-Special Judge, Excise, Chapra,
