The Block Education Officer lodged the case registered under Sections 420, 384, 34 of the Indian Penal Code vide Ram Nagar P.S. Case No. 164 of 2016 alleging that the C.D.P.O. through her staff was forcibly collecting money from the Aanganwadi Sevika. On such complaint, a search was conducted and from the possession of the petitioner a sum of Rs. 9,000/- was recovered. The petitioner was the driver of the C.D.P.O. The contention of the petitioner is that it was the money for fuel of the vehicle. The C.D.P.O. has been granted anticipatory bail by the court below.

Patna High Court Cr.Misc. No.46026 of 2016 (4) dt.05-12-2016 2/2 Mr. M. Dayal, on the other hand, points out that the recovery of the collected amount was made from the petitioner. Looking to the allegations made in the First Information Report and other materials reflected from the records, I am not persuaded to extend him the privilege of anticipatory bail. The prayer is rejected.

The petitioner may surrenders and prays for regular bail. If he does so, the same shall be considered by the court below on its own merit in accordance with law. (Kishore Kumar Mandal, J) rohit/- U T
