Petitioner apprehends his arrest in connection with Samastipur Town P.S.Case No. 157 of 2017 registered for the offences punishable under Sections 420 and 406/34 of the Indian Penal Code.

Petitioner is contract worker, who used to fill cash in ATMs and on 26,5,2016 ATMs of Canara Bank were search and found shortage of amount of Rs.9,48,500/- and allegation is against the petitioner of defalcation of the said amount. Submission of learned counsel for the petitioner is that daily accounting was made and the same was verified, as such, there is no question of defalcation of money by the petitioner and he has falsely been implicated in this case because he has objected

Patna High Court Cr.Misc. No.11323 of 2018 (3) dt.03-04-2018 2/2 to the working style of senior officer of the company. Heard learned APP also.

Having heard both sides and in view of prima facie allegation made against the petitioner, I am not inclined to grant anticipatory bail to him. His prayer is rejected. However, petitioner should surrender and pray for regular bail, which shall be considered on its own merit. (Vinod Kumar Sinha, J) spal/- U
