The petitioner apprehends arrest in a case registered for the offence punishable under sections 420/120B and other ancillary sections of the Indian Penal Code.

Prosecution's case, in brief, is that in the light of order passed by this Court in C.W.J.C.No. 15459 of 2014, Vigilance enquiry was conducted and petitioner was found to be appointed on the post of teacher in the block on submission of forged mark-sheet showing his marks as 531 while in original marksheet it was 360. Learned counsel for the petitioner submits that the petitioner is innocent and while holding his mark-sheet to be forged and fabricated, neither any enquiry was conduced by the authorities nor the petitioner was noticed and heard in this regard. Besides this, he had been offered the job after complete verification of his educational certificates by the competent authorities and he is still in job. Petitioner has got no criminal

In the facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in Brahmpur (Krishna Brahm) Police Station Case No. 65 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
