The petitioner seeks bail in Sessions Trial No. 278 of 2018 arising out of Palasi P.S. Case No. 79 of 2003, instituted for the offence under Section(s) 304(B) of Indian Penal Code.

Counsel for the petitioner submits that petitioner is Gotni of the deceased. She has voluntarily surrendered in the court on 25.3.2019 and since then she is in custody. Husband of the deceased faced trial in Sessions Trial No. 557 of 2007 and has been acquitted by Judgment dated 15.9.2007. In the written report there is general and omnibus allegation against the petitioner.

Petitioner is in custody since 25.3.2019 having

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Araria, in connection with Sessions Trial No. 278 of 2018 arising out of Palasi P.S. Case No. 79 of 2003, subject to the condition that both the bailors will be close relatives of the petitioner.
