1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Amba Police Station Case No. 15 of 2025, dated 24.01.2025, disclosing offences under Sections 109/126(2)/118(1)/118(2)/352/351(2)/3(5) of the Bhartiya Nyaya Sanhita.
3. The prosecution case, as per the First Information Report, is that on 22.01.2025, the petitioner, who is the owner of the Mahadev Automobiles, along with his sons, namely, Amit Kumar, Abhishek Kumar and Vikash Kumar, stopped a tempo vehicle of the informant, deboarded the passengers, abused the driver Sunil Kumar and seized the tempo, bearing registration no. BR25-PA-0307.
Patna High Court CR. MISC. No.25660 of 2025(2) dt.07-05-2025 2/3 Thereafter, the informant, along with his father, visited Mahadev Automobiles, where, the petitioner abused and assaulted the informant and his father with iron rod.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case due to non-payment of installments of the tempo purchased by the informant on hire purchase basis. He further submits that the injuries sustained by the informant and his father is simple in nature as would be evident from injury report annexed at Annexure-2 series.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that there was dispute regarding payment of installment of the tempo which was purchased on hire purchase basis by the informant and the injuries sustained by the informant and his father are simple in nature, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount

No.25660 of 2025(2) dt.07-05-2025 3/3 each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Amba Police Station Case No. 15 of 2025, subject to the condition laid down under Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
