2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 80(2) and 3(5) of the B.N.S..
3. It is a case of dowry death. As per prosecution case, daughter of informant was married with this petitioner on 22.06.2022. After marriage, one child was born out of the wedlock. It is alleged that on 05.08.2024 informant received information that all the F.I.R. named accused persons, including this petitioner, have committed murder of her daughter due to non-fulfillment of demand of dowry.

4. It is submitted by learned senior counsel appearing on behalf of the petitioner that petitioner is innocent and has committed no offence. Petitioner has falsely been implicated in this case merely because he happens to be husband of the victim. Informant is not an eye witness of the occurrence. There are general and omnibus allegations and there is no specific allegation of demand of dowry or torture against this petitioner. The relationship between the victim (wife) and this petitioner was very normal and there was no dispute between them. As a matter of fact, the victim died due to snake bite and the same is also corroborated by the post mortem report issued by the Deputy Superintendent, Sadar Hospital, Banka. Petitioner claims clean antecedents.

On the other hand, learned A.P.P. for the State and learned counsel appearing on behalf of the informant have vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R. with specific accusation that he, along with other accused persons, killed victim due to non-fulfillment of demand of dowry. It is further submitted that the victim died unnatural death at her matrimonial house within 7 years of marriage and there is allegation of demand of dowry.

6. Considering the nature of accusation and the fact that the victim died unnatural death at her matrimonial house within 7 years of marriage, the prayer for grant of anticipatory bail to the petitioner is rejected.
