====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 22-04-2019 Heard learned counsel for the petitioners and the State.

The petitioners seek bail in Yadopur P.S. Case No. 24 of 2019, instituted for the offence under Section (s) 414 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that 241.92 litres of foreign liquor has been recovered from a car bearing registration No. DL4CAB-5229. Petitioner was found sitting in the aforesaid car.

Counsel for the petitioners submits that petitioners are not owner of the Car. They have no concern with the recovery of illicit liquor.

Patna High Court CR. MISC. No.24761 of 2019(2) dt.22-04-2019 2/2 Petitioners are in custody since 20.3.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge/Special Judge, Excise, Gopalganj, in connection with Yadopur P.S. Case No. 24 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioners.
