ANJANA MISHRA ORAL ORDER 17-08-2017 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case registered under Sections 341, 323, 506, 307, 379 and 34 of the Indian Penal Code.
Learned counsel for the petitioners submits that admittedly there is dispute with regard to construction of house over ancestral house, which has been demolished. It is further submitted that petitioner no.2 is the full brother of the informant and petitioner no.1 is the nephew of the informant. It is further submitted that the petitioners had been apprehending that there may be some altercation on the part of the brother. Admittedly it is a case of land dispute and the parties are close relatives.
