1. The present writ petition has been filed seeking the following relief(s):- "1.i) To issue an appropriate writ order / direction in the nature of Certiorari for quashing the office order bearing letter no. 143 dated 21.11.2017 issued under the signature of the Principal Chief Conservator of Forest (HOFF) by which the departmental promotion committee on the basis of meeting dated 16.11.2017 has granted promotion from the post of Forest Guard to the post of
Patna High Court CWJC No.7079 of 2022(2) dt.20-03-2024 2/3 Forester in which illegally the name of the petitioner has not been considered for promotion. ii) To issue an appropriate writ order/direction in the nature of Mandamus commanding the respondents to publish a fresh office order incorporating the name of the petitioner at serial no. 51 in the promotion list.
iii) To issue an appropriate writ order/direction in the nature of Mandamus commanding the respondents to grant promotion to the petitioner on the post of Forester w.e.f., 21.11.2017, the date on which the other similarly situated forest guards and juniors of the petitioner have been granted promotion on the basis of the meeting of departmental proceeding of the committee dated 16.11.2017.
iv) To issue an appropriate writ order/direction in the nature of Mandamus commanding the respondents to consider the case of the petitioner for granting additional charge of the post of ranger officer on the basis of promotion to the post of Forester w.e.f. 21.11.2017.
v) To issue an appropriate writ order/direction in the nature of Certiorari commanding the respondents to pay the arrears/difference of the salary with all consequential benefits from the period 21.11.2017 till today."
2. At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the
Patna High Court CWJC No.7079 of 2022(2) dt.20-03-2024 3/3 respondent no.3, i.e. the Principal Chief Conservator of Forest (HOFF)-cum-Administration and Human Resources Development Environment, Forest and Climate Change Department, Government of Bihar, for redressal of his aforesaid grievances. Liberty so sought is granted.
3. It is needless to state that in case appropriate representation is filed by the petitioner, before the respondent no.3, i.e. the Principal Chief Conservator of Forest (HOFF)- cum-Administration and Human Resources Development Environment, Forest and Climate Change Department, Government of Bihar, within a period of two weeks from today, the same shall be considered, in accordance with law and a reasoned and a speaking order shall be passed, thereon, within a period of six weeks, thereafter.
4. The writ petition stands disposed off on the aforesaid terms.
