05-02-2015 Heard learned counsel for the petitioner and learned A.C. to Govt. Pleader - 2.

The present writ petition was filed in the year 2007 with a prayer to quash a letter, bearing no. 1382-1434 dated 15-10-1993 i.e. Annexure '9' to the writ petition, whereby, the Library Superintendent had issued letter to take steps for retiring persons, who had attained the age of 60 years. In this case, the petitioner has also filed supplementary affidavit and in supplementary affidavit, it has been indicated that the petitioner retired in the year 1993 itself. Learned counsel for the petitioner submits that subsequently, vide Annexure '10', the Library Superintendent had passed an order for staying the operation of letter no. 1382-1434

Patna High Court CWJC No.13470 of 2007 (2) dt.05-02-2015 2/2 dated 15-10-1993 i.e. a communication, which was earlier made for taking steps for retiring the persons, who had attained the age of 60 years.

Since the petitioner on his own statement has stated that he superannuated in the year 1993 itself and the writ petition has been filed in the year 2007, no relief can be granted to the petitioner.

The writ petition stands dismissed.
