ANJANA MISHRA ORAL ORDER 16-08-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Paroo P.S. Case No.48 of 2003 for allegedly having committed the offence under Sections 341, 436, 427 and 380/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the name of the petitioner has been brought into the present case only on suspicion. Though it is alleged that the petitioner as brother of one Saheb Singh has participated in the occurrence, it is submitted by the learned counsel that the petitioner is not at all the brother of Saheb Singh and parentage of said Saheb Singh has not been disclosed in the F.I.R. Furthermore, there is

Patna High Court Cr.Misc. No.25785 of 2016 (3) dt.16-08-2016 2/2 nothing to indicate as to who had set the house on fire. The petitioner is the son of Late Prasidh Singh and till date he has no criminal antecedents.

Considering the vague nature of allegations made, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, West Muzaffarpur, in connection with Paroo P.S. Case No.48 of 2003, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
