JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-04-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 395, 412 of the Indian Penal Code.

Although petitioner is named in the first information report but admittedly, petitioner was neither caught on the spot nor anything was recovered from his conscious possession. Petitioner does not have any criminal antecedent which is evident from perusal of Para-3 of the petition and is languishing in jail custody since 05.02.2019.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above

No.24597 of 2019(2) dt.17-04-2019 2/2 named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 770 of 2018, G.R. No. 3612 of 2018.
