The petitioners seek pre-arrest bail in connection with Khanpur P.S. Case No.55 of 2017 registered under Sections 147, 148, 149, 323, 324, 307, 374, 504 and 506 of the Indian Penal Code.
Regard being had to the submissions made by the learned counsel for the petitioners that on account of land dispute
Patna High Court Cr.Misc. No.41730 of 2017 (2) dt.20-09-2017 2/2 scuffle took place in which members of both sides sustained injuries and the injuries sustained on the person of the members of the prosecution party were all found simple in nature, the petitioners, who are said to be men of clean antecedent, namely, 1.Vijoy Sah @ Vijay Sah, 2.Ajay Sah, 3.Sanjay Sah, 4.Baleshwar Sah @ Baleswar Sah, 5.Kanhai Sah @ Kanhaiya Sah, 6.Rohit Sah, 7.Chandeshwar Sah, 8.Pankaj Sah, 9.Arjun Sah and 10.Baidyanath Sah @ Baijnath Sah are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Samastipur in connection with Khanpur P.S. Case No.55 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
