The petitioner seeks bail in Rail P.S. DBG (Sitamarhi) Case No. 186 of 2018 registered under Section 379/411 of the Indian Penal Code.

Petitioner is said to have pick-pocketed Rs.2600 of the informant at the booking counter of the Sitamarhi railway station during course of purchasing ticket.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. The petitioner has committed no offence and has no concern with the aforesaid occurrence. No incriminating article has been recovered from his conscious physical possession. As a matter of fact, there was

No.23755 of 2019(2) dt.12-04-2019 2/2 some altercation between the informant and the petitioner over purchasing ticket standing in the long queue and due to aforesaid grudge the informant has got the petitioner falsely implicated in this case by planting the aforesaid recovery from his possession. The petitioner has been languishing in custody since 19.08.2018.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate (Railway), Samastipur in connection with Rail P.S. DBG. (Sitamarhi) Case No.186 of 2018.
