The facts are admitted in the case in hand that the petitioner, who was working on the post of Nayak Radio Operator, CRPF, has tendered his resignation in the month of December, 1989, which was duly accepted w.e.f. 31.01.1991. Despite rendering his service from 1973 to 1991, he has not been allowed the amount of gratuity, for which he had been pursuing the remedy before all the authorities concerned and

Patna High Court CWJC No.7202 of 2022 dt.27-02-2025 2/2 lastly approached this Court by filing the present writ petition.

Considering the aforenoted facts that the resignation of the petitioner was duly accepted way back in the year 1991 and all the admissible dues have been paid to thim long back in the year 2003, but the present writ petition has been preferred after a delay of 18-19 years, this Court does not find any reason to entertain the writ petition on account of delay and laches.

4. Time without number, the Apex Court in catena of judgments has deprecated the representation syndrome and the same cannot be taken into account to condone the delay and laches.

5. For the aforesaid reasons, this Court does not find any merit in the writ petition. Accordingly, the same stands dismissed, on account of delay and laches.
