1. Heard learned counsel for the petitioner and learned counsel for the C.B.I.

2. The present application has been filed for quashing of the order dated 09.10.2015 passed by the learned Special Judge, C.B.I.-I, Patna in Special Case No. 07 of 2011 arising out of R.C. Case No. 10A of 2010 (Newly R.C. 10A/2011) refusing to discharge the petitioner in this case for the offences under Sections 120(B), 420, 467, 468, 471 of the Indian Penal Code read with Sections 13(2) and 13(1)(d) of the Prevention of Corruption Act, 1988.

3. Learned counsel for the petitioner, at the outset, very fairly submits that after filing of this application charges were framed, trial commenced and 12 witnesses have been examined.

4. Since the trial has commenced and witnesses have been examined, as such, the Court is not inclined to entertain this application.
