2. In this case, the petitioner is seeking regular bail in connection with Jalalgarh P.S. Case No. 79 of 2023, registered for the offences punishable under Sections 363, 366 of the IPC and section 8 of the POCSO Act.

3. As per allegation, the niece of the informant went out her house but she didn't return. The informant and his family members started searching for her and came to know that the petitioner kidnapped his niece, with an intention to marry her.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

He has submitted further that the victim, in her statement under Section 164 of the Cr.P.C., has specifically stated that she has solemnized marriage with the petitioner with her own sweet will.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances as well as statement of the victim recorded under Section 164 of the Cr.P.C., let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 6th cum Special Judge (POCSO Act), Purnea in connection with Jalalgarh P.S. Case No. 79 of 2023, subject to the following condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
