JUSTICE MOHIT KUMAR SHAH ORAL ORDER 02-12-2022 The limited prayer of the petitioner in the present writ petition is to direct the Circle Officer, Raxaul, East Champaran to finally conclude the proceedings of the Encroachment case no. 37 of 2019-20 and remove the encroachment in question.
The learned counsel for the respondent State fairly submits that in case, the Circle Officer, Raxaul, East Champaran comes to a finding that the land in question has been encroached, he will definitely take steps, in accordance with law and ensure removal of the encroachment in question, forthwith.
Having regard to the facts and circumstances of the case, I deem it fit and appropriate to direct the Circle Officer, Raxaul, East Champaran to conclude the proceedings of the aforesaid Encroachment case no. 37 of 2019-20, if not already concluded, by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, in accordance with law and after hearing the affected parties, as also take consequential action
Patna High Court CWJC No.7179 of 2022(2) dt.02-12-2022 3/3 thereon, within a period of eight weeks of receipt/ production of a copy of this order.
The writ petition stands disposed off on the aforesaid terms.
