The petitioner is languishing in custody for the offences punishable under Sections 341, 342, 323, 307, 498 (A), 504/34 of the Indian Penal Code.
The impugned order reveals that the petitioner, who is husband of the informant, had expressed desire for restitution of cordial life with the informant. It is a case under Section 498A of the Indian Penal Code.
In the circumstance, let the petitioner, above named, be released on provisional bail for six months on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the
Patna High Court CR. MISC. No.26932 of 2019(2) dt.24-04-2019 2/2 learned Court-below where the case is pending in connection with Salimpur P.S. Case No. 06 of 2019, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below. (b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. In the meantime the petitioner shall take step for restoration of conjugal life with the informant. If the court below would found that the informant does not want to go with the petitioner, the provisional bail shall be confirmed by the court below itself. (Birendra Kumar, J) Banti/Rajan U T
