JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-12-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 323, 341, 354, 379, 307, 34 of the Indian Penal Code. The accusation is of making assault to the informant and family members of the informant. It is alleged that petitioner No. 1 outraged the modesty of the daughter and daughter-in-law of the informant.

It is submitted by learned counsel for the petitioners that there is counter version of the occurrence and the injuries have been found to be simple in nature. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks

Patna High Court Cr.Misc. No.56188 of 2015 (2) dt.17-12-2015 2/2 from today, be released on provisional anticipatory bail for three months on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bhojpur at Ara in connection with Piro P.S. Case No. 341 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

Let learned Court below verify from the records that no grievous injury has been caused to the informant's side and if it is found no grievous injury has been caused to the informant's side then provisional bail of the petitioners will be confirmed by learned court below, otherwise petitioners will surrender and pray for regular bail.
