The petitioner apprehend his arrest in connection with C-III No. 33 of 2019 registered under Sections 30(a) of Bihar Prohibition & Excise Act-2016.

16.380 lts. of foreign liquor is said to have been recovered from the straw house of the petitioner and he managed to escape.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He has been falsely implicated in this case. He has no concern with the seized liquor. The aforesaid straw house is belonging to several other

Patna High Court CR. MISC. No.25327 of 2019(2) dt.19-04-2019 2/2 family members of the petitioner and he had no knowledge of keeping of liquor there. He has no criminal antecedent. In the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District & Sessions Judge-II-cum-Special Judge (Excise) Siwan in connection with C-III No. 33 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
