JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 26-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends her arrest in connection with Arwal P.S. Case No. 242 of 2016, registered under Sections 419, 420, 467, 468, 471 and 120-B of the Indian Penal Code. The accusation is that in course of inquiry in respect to appointment of Panchyat Teacher in district-Arwal one Ankita Bharti, Wife of Udai Kumar, permanent resident of village-Kothia, Manikpur, P.S. Kurtha, District-Arwal was found engaged on the post of Panchayat Teacher at Primary School, Lalchak in Nidhawa Gram Panchayat and one other lady, who is also named as Smt. Ankita Bharti, father/husband Ranvijay Kumar, Village Rozapar, P.S. Arwal, District-Arwal was also found appointed as Teacher in New Primary School, Bhimpura situated in Phakhpur Panchyat, District-Arwal and certificate of both teachers were found same. On notice, the petitioner

Patna High Court Cr.Misc. No.25160 of 2017 (4) dt.26-07-2017 2/2 appeared with the documents, whereas other teacher i.e. Smt. Ankita Bharti, father/husband Ranvijay Kumar, Village Rozapar, P.S. Arwal, District-Arwal did not appear on verification the signature was not matched.

Learned counsel for the petitioner submits that, in fact, the petitioner appear before the Enquiry Officer and certificate as produced by her was found genuine by the Bihar School Examination Board, which has detailed in paragraph Nos. 7, 8 and 9 of the counter affidavit filed by the Secretary, Bihar Examination Board, Patna. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Arwal in connection with Arwal P.S. Case No. 242 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
