Petitioner seeks anticipatory bail in L.N.M.U. P.S. Case No.257 of 2017 instituted for the offence under Sections 302, 201, 120(B) of the I.P.C.
Informant who is the father of the deceased has alleged in his F.I.R. that on 23.10.2017 in the evening at about 7 P.M. three persons, namely, Billat @ Ajit Kumar Sahni, Deepak Kumar and Aman Kumar had left his house accompanying the deceased son which was seen by his daughter from the roof of his house on 23.10.2017 when he was driving his three wheeler, he was informed that his son was murdered and his dead body has been
Patna High Court Cr.Misc. No.2534 of 2018 (2) dt.17-02-2018 2/2 found. He has further stated in his F.I.R. that about eight months earlier petitioner had an altercation with the informant and he has suspicion that all the accused persons in conspiracy have killed his son. Lastly it has been alleged that at about 10.30 at night the deceased son of the informant was seen on motor cycle of Kanhaiya Kumar and thereafter no trace of him could be found and on the next morning his dead body was found. It has been submitted by the counsel for the petitioner that he is innocent and has been falsely implicated in this case. He has no criminal antecedent and on the basis of suspicion only he has been named in the F.I.R. by the informant.
Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Darbhanga, in L.N.M.U. P.S.Case No.257 of 2017 subject to the condition as laid down under Section 438(2) of Cr.P.C.
