Petitioner seeks regular bail in connection with Bettiah Town PS Case No. 810/2020 registered for the offences punishable under Sections 461/379 of the IPC and later on Sections 411/413/414 were also added.

As per First Information Report, unknown miscreants stole 66 pieces of Smart phones of Rs. 7,70,000/- and mobile accessory of Rs. 50,000/- from the shop of the informant in the night of 18.12.2020.

Learned counsel for the petitioner submits that the petitioner is a lady and not named in the First Information Report. He further submits that during course of investigation,

No.33591 of 2021(2) dt.21-12-2021 2/3 confessional statement of one Vikash Kumar was recorded who disclosed the name of one co-accused, Ritik Kumar, son of the petitioner and from his room mobile accessory along with some cash was recovered kept in a box. Learned counsel further submits that since the petitioner happens to be mother of the said co-accused, Ritik Kumar, she has been dragged in this case by the police.

It is further submitted that one another co-accused person, namely, Noor Mohammad Khan whose bail application was rejected by the learned court below, has been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 27910/2021.

Learned counsel also submits that the petitioner is in custody since 22.12.2020 having no criminal antecedents. Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that similarly situated co-accused person has been granted bail by a Bench of this Court, the petitioner being a lady is in custody since 22.12.2020 having no criminal antecedents, I am inclined to grant regular bail to the petitioner.
