JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-08-2022 Heard learned counsel for the petitioner and the State. The petitioners apprehend their arrest in connection with Tajpur Halai P.S. Case No. 65 of 2022 registered for the offence under Sections 272 and 273 of the Indian Penal Code and Sections 30(a) and 41(i)(ii) of the Bihar Prohibition and Excise Act, 2018.

Recovery of 1067.40 liters of illicit liquor has been made from the vehicles and courtyard of house of the coaccused Sudhir Thakur. Petitioner has been made accused in this case on the basis of confessional statement of co-accused, Gunjan Kumar.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the

Patna High Court CR. MISC. No.26394 of 2022(2) dt.05-08-2022 2/2 case. No incriminating article has been recovered from the conscious possession of the petitioner and he is no way concerned with the alleged recovery. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act (02), Samastipur in connection with Tajpur Halai OP PS case No. 65/ 2022, subject to conditions laid down u/s 438(2) of the Cr. P. C.
