2. The present petition has been filed on behalf of the petitioner seeking modification of order dated 03.11.2015 passed in Cr. Misc. No. 47166 of 2015 by which the petitioner along with two others were allowed anticipatory bail granting six week's time to surrender before the learned trial Court in connection with Mairwa P.S. Case No. 108/2015.
3. It is submitted that due to inadvertent typographical error in the cause title of the order dated 03.11.2015, the name of the petitioner no. 3 was wrongly stated as "Naresh Singh" instead of his correct name "Rajesh Singh". It is further stated that due to communication gap between the petitioner and his counsel the petitioner could not surrender and furnish bail bond before the
Patna High Court Cr.Misc. No.7708 of 2018 (2) dt.04-04-2018 learned Court below within the stipulated time. It is therefore, prayed that the order dated 03.11.2015 may be modified by indicating his correct name "Rajesh Singh" instead of "Naresh Singh" and the time granted for surrender before the learned Court below may also be extended by two weeks from today.
4. Let the name of petitioner no. 3 in the cause title of order dated 03.11.2015 passed in Cr. Misc. No. 47166 of 2015 be corrected to read as "Rajesh Singh" instead of "Naresh Singh". The time granted for surrender before the learned Court below in terms of the aforesaid order is also extended by two weeks from today.
5. The order no. 3 dated 03.11.2015 passed in Cr. Misc. No. 47166 of 2015 is modified to the above extent only. The petition stands disposed of as above.
