JUSTICE MOHIT KUMAR SHAH ORAL ORDER 15-02-2023 The present writ petition has been filed seeking the following relief:- "1. That this is an application for the issuance of an appropriate writ/ writs in the nature of certiorari for quashing the order dated 09.05.2003 passed by Executive Siwan Municipality whereby and whereunder he was pleased to hold that taking into consideration the future of Malviya Nagar mohalla with regard to the extensions it is opined that the wide of the previous road may be extended with extent to the 18 feet and

Patna High Court CWJC No.5924 of 2006(3) dt.15-02-2023 2/3 Junior Engineer was directed to prepare a Draft/ Report and place before him and the further payer of the petitioners for quashing the order-dated 14.07.2003 issued by the Executive Officer, Siwan Municipality whereby and whereunder the map prepared for the Malviya Road is declared as a public road and the concern assistant was directed for the proper communications even without considering the claims and the submission of the parties for the determination of the issue involved in the present case as well as the notice issued under the Letter No. 529 dated 24.04.2006 whereby and whereunder all concerns have been directed to remove the alleged encroachment by 30.04.2006 failing which the necessary steps will be taken in this regard and for the other necessary relief/ relief's on the basis of the facts and the circumstances of the case stated hereinafter."

Patna High Court CWJC No.5924 of 2006(3) dt.15-02-2023 3/3 At the outset, the learned counsel for the petitioners seeks liberty on behalf of the petitioners to approach the Executive Officer, Siwan Municipality, for redressal of their aforesaid grievances. Liberty, so sought, is granted.

The writ petition stands disposed off.
