JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-08-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Dinara P.S. Case No. 206 of 2016, registered under Sections 341, 342, 323 and 307/34 of the Indian Penal Code. The accusation is that petitioners along with Raj Narayan Singh and Deo Narayan Singh came at the door of the informant having armed with Farsa and other weapons. At that time, petitioner no. 1, Shashi Kant Singh, gave Farsa blow at the head of Mukesh Singh, son of the informant, whereas petitioner no. 3, Mangaru Singh, also instigated to accused persons to kill the

Patna High Court Cr.Misc. No.18120 of 2017 (3) dt.02-08-2017 son of the informant then his son was locked in the room. Thereafter, police came there and got free to Mukesh Singh, son of the informant.

Learned counsel for the petitioner submits that, in fact, due to land dispute occurrence took place, in which, co-accused, Deo Narayan Singh also sustained injury, regarding which, Dinara P.S. Case No. 207 of 2016 is also instituted on the basis of written report of Raj Narayan Singh, father of petitioner no. 2. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Bikramganj, Rohtas, in connection with Dinara P.S. Case No. 206 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
