JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-05-2019 The petitioner seeks regular bail in connection with Dhamdaha P.S. Case No. 159 of 2016, registered for offences punishable under Sections 457, 380, 411/34 of the Indian Penal Code.
Allegation is of commission of theft in the house of informant and, thereafter, informant and others chased the miscreants and one of the miscreants was apprehended and he disclosed the name of petitioner as his one of the associate. Apart from that petitioner is an accused in three more cases. It has been submitted on behalf of the petitioner that he has been made accused in this case only on the basis of confessional statement of co-accused and except that there is nothing against the petitioner and he has been in judicial custody since 29.01.2019 and though he is accused in three
Patna High Court CR. MISC. No.25541 of 2019(3) dt.22-05-2019 2/2 more cases but in two of the cases he has been acquitted, which he has mentioned on oath in para -3 of the petition. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Dhamdaha P.S. Case No. 159 of 2016, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
