The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 407, 420 and 435/34 of the Indian Penal Code.
The informant had booked refined oil which was being carried on the truck driven by the petitioner. Allegation is that the refined oil was removed by the petitioner and the truck was burnt just to save the skin from the allegation that, in fact, the refined oil was sold by the petitioner.
Submission is that, in fact, the truck burnt due to some short-circuit. The informant had also seen the burnt truck, hence, only suspicion is there against the petitioner. Moreover, civil remedy is there for compensation from the transporter of
Patna High Court Cr.Misc. No.52019 of 2016 (2) dt.20-12-2016 which vehicle the petitioner was driver.
Let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya/Successor Court in connection with Belaganj Police Station Case No. 111 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
