The petitioner apprehends his arrest in connection with Baniyapur P.S. Case no. 350 of 2018, registered under Sections 341, 323, 498(A) and 504/34 of the Indian Penal Code and Section 3 / 4 of the Dowry Prohibition Act. The accusation is of torturing of the informant/O.P. No.2 by her husband and other in-laws due to non-fulfillment of demand dowry and removing her from matrimonial house causing assault.
Learned counsel for the petitioner submits that petitioner is the husband of the informant/O.P. No.2. Further submission is that on the joint prayer of the parties, the matter
Patna High Court CR. MISC. No.25083 of 2019(6) dt.28-11-2019 2/2 was referred before the Mediation Centre, Patna High Court, Patna, while petitioner expressed his desire to keep the informant/O.P. No.2 with full dignity, but informant/O.P. No.2 expressed her desire one time settlement due to that reason, the matter could not be settled.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in connection with Baniyapur P.S. Case No. 350 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
