The petitioner is apprehending his arrest in connection with Begusarai Mufasil (Lakho) P.S. Case No. 376 of 2016 for the offences instituted under Sections 304(B) of the IPC. The accusation is of killing the daughter of the informant by the accused persons due to non-fulfilment of dowry demand. It has been submitted on behalf of the petitioner that the petitioner has falsely implicated in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is the father-in-law of the deceased. He is separate in mess and property from the husband of the
Patna High Court Cr.Misc. No.54197 of 2016 (2) dt.21-12-2016 2/2 deceased's family. The children of the deceased aged 09 and 10 years old have been examined under 164 Cr. P.C. They have not supported the prosecution case. It is a case of suicide. The other co-accused has been granted anticipatory bail by this Court vide Cr. Misc. No. 50797 of 2016.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Muffasil (Lakho) P.S. Case No. 376/2016 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
