Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner has preferred this application for grant of regular bail in connection with Bihpur P.S. Case No. 57 of 2020 dated 15.2.2020 registered for the offences punishable u/s 147, 148, 149, 302, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.
Patna High Court CR. MISC. No.27957 of 2023(2) dt.25-05-2023 2/3 As per the prosecution case, the petitioner along with four named accused persons and two unknown persons abused and assaulted the son of the informant.
Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. There is land dispute between the parties. The specific allegation of firing is against the other co-accused persons. The co-accused Mukesh Kumar has already been granted bail by the Coordinate Bench of this Court vide order dated 4.8.2022 passed in Cr. Misc. No. 13636 of 2022. The petitioner has got clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 23.6.2022. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bhagalpur in connection with Bihpur P.S. Case No. 57 of 2020.
