2. The present petition has been preferred for the grant of following relief(s):
"(i) for issuance of a writ in the nature of certiorari for quashing of the 2nd Provisional Seniority List of 773 Unlicensed Applicants of Saw Mills" dated 17.02.2026 (Annexure-R-6) finalized by the Principal Chief Conservator Forest (Development) Bihar (Respondent No. 4)
2/4 whereby the petitioner has allegedly been excluded from the aforesaid Provisional Seniority List without asking any show cause notice in the facts and circumstances of this case.
(ii) for issuance of a writ in the nature of mandamus directing the Principal Chief Conservator of Forest (Development) Bihar (Respondent No. 4) to hold and declare the 1st Provisional Seniority List of 1124 applicants dated 18.02.2025 is legal and valid (AnnexureR-4) finalised by the Additional Chief Conservator of Forest (Campa)-cum-Nodel Officer (Forest Conservation), Bihar, Patna as the aforesaid provisional seniority list of 1124 saw mills has been finalized on the basis of date of application of license under the Bihar Saw Mills (Regulation) Act, 1990 available with the concerned Licensing Officer.
(iii) for issuance of a writ in the nature of mandamus directing the Respondent No.4 Principal Chief Conservator of Forest, Bihar
3/4 (Development), Patna to decide the objection dated 27.02.2026 (Annexure-R-7) filed by the petitioner against the 2nd Provisional Seniority List of Saw Mills dated 17.02.2026 in terms of Notification No. 3240 dated 29.08.2023 issued by the Department of Environment, Forest and Climate Change, Government of Bihar.
(iv) for issuance of a writ in the nature of mandamus directing the Respondent No. 4 Principal Chief Conservator of Forest (Development) Bihar to include the application of license of the petitioner dated 20.12.1996 in the final seniority list in the facts and circumstance of this case.
(v) for issuance of such other writ(s), order(s), direction(s) as your Lordships may deem fit and proper."
3. At the outset, learned State counsel pointed out that the objection of the petitioner is pending before the respondent Principal Chief Conservator of Forest, Bihar, Patna and it will be taken to its logical conclusion.
4. In that background and an undertaking given by the
4/4 learned State counsel, the writ petition is disposed of directing the concerned respondent to dispose of the objection of the petitioner if still not disposed of, at an earliest preferably within a period of three months from the passing of the present order.
5. This Court expects that the list will be prepared by the respondent authorities shall strictly will be in accordance with law and not otherwise.
