This M.J.C. application has been filed for restoration of First Appeal No.554 of 1979. It appears that the said first appeal was dismissed for non-compliance of order dated 06.04.2004 whereby the petitioner was directed to file initial printing cost and the appellant's list for preparation of paper book. Now it may be mentioned here that paper book department of Patna High Court has already been abolished. Moreover, because of non-filing of appellant's list or printing cost, the appeal could not have been dismissed.
