By order dated 11-12-2017, a report was called for from the court below as to whether investigation in the case has been completed or not. The report has been received. It has been mentioned in the report that investigation has not been completed and charge sheet has also not been submitted by investigating officer.
This petition has been filed for quashing the FIR of Natwar P.S. Case No. 34 of 2012.
It has been submitted on behalf of the petitioner that though registration No. as mentioned in the written report is of the truck of this petitioner which is six wheeler vehicle but in fact, the case has been registered for the offence under Sections-279, 337, 338/304A of the Indian Penal Code relating to a truck of 12 wheelers.
This court finds that the above submission of the petitioner can be

Therefore, this court does not find any merit in this petition. Accordingly, this quashing petition is dismissed. The police is directed to complete the investigation and submit final report in terms of Section-173 Cr.P.C. after completion of investigation within three months from date of receipt of this order. The District Judge, Sasaram, Rohtas will communicate the order to the Superintendent of Police, Sasaram, Rohtas for compliance.
