JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 27-08-2020 Heard Mr. Vaidehi Raman Prasad Singh, learned Counsel for the petitioner and Mr. Parmeshwar Mehta, learned Additional Public Prosecutor for the State.
The petitioner is in custody in connection with Runni Saidpur P.S. Case No.182 of 2020 registered for the offences under Section 363 and 366A/34 of the IPC.
Learned counsel appearing on behalf of the petitioner would submit that there was love affairs in between the petitioner and the victim girl as is evident from the statement of the girl under Section 164 Cr.P.C. However, Counsel admits that the girl is minor and her consent has no relevance. He submits that the petitioner is also 19 years old and as such the Court may consider the desirability of providing one opportunity to mend his way. The petitioner has no criminal antecedent.

No.22528 of 2020(2) dt.27-08-2020 2/2 Considering the fact that the petitioner has no criminal antecedent and the assurance that he will keep himself away from the girl, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Sitamarhi, in connection with Runni Saidpur P.S. Case No.182 of 2010, subject to the following conditions:
1. Bailer shall be the family members,
2. the petitioner shall not try to contact the girl or develop any relationship in any manner, so long the girl is minor, and
3. In the event the petitioner is found indulged in activity to induce the girl, the court below shall be at liberty to cancel his bail bond.
